13 Contractor of Record providers we score
21 EOR providers covering Canada, if the work turns into employment
US$99 lowest published EOR starting price a month, in US dollars, if you switch
A Canadian contractor stays outside your payroll while what both sides intended matches how the work actually runs, as the Canada Revenue Agency reads it. When it does not, the payer owes the CPP and EI it failed to deduct, both shares.
Short answer
Outside Quebec the CRA asks first what both sides intended, then checks it against six factors, control among them.
The payer's right to control counts even when the payer never exercises it.
The worker or the payer can ask for a CPP/EI ruling by June 29 of the following year.
A contractor is the first owner of copyright in what they create; only a signed written assignment moves it.
On this page
Where the employee line runs in Canada
The CRA works in two steps. It first asks the worker and the payer what they intended when they entered into the arrangement, then checks that intent against how the work runs: the payer’s control, who provides tools and equipment, whether the worker can subcontract or hire assistants, financial risk, responsibility for investment and management, and the chance of profit.[1] It is the payer’s right to control that matters, so a manager who could assign daily tasks but rarely does still weighs on the employee side. Quebec runs a different test under its Civil Code, built on subordination.
Status can be settled before a dispute. Either side can ask the CPP/EI rulings program by June 29 of the following year, and the ruling covers CPP and EI only, not income tax.[1]
Incorporating does not change the answer by itself. If the person would reasonably be your employee but for their corporation, the CRA can treat it as a personal services business, which loses the small business deduction and pays an additional 5% tax.[2] The status block and the mistakes table show what a wrong call costs the payer.
Setting up the contract and IP
The agreement records intent, which is where the CRA starts, but only holds if the work matches it: the contractor sets methods and hours, brings equipment, can send an assistant and carries the financial risk.
Copyright needs its own clause. Under the Copyright Act, first ownership goes to whoever created the work, with one exception for employers: works their staff produce while employed. Transfers count only when written and signed by the owner.[3] A contract that says nothing on IP leaves the client without the copyright.
A contractor whose worldwide taxable supplies stay at or under CAD 30,000 need not register for GST/HST.[4] On your side, fees for services above CAD 500 a year paid to a business are reported to the CRA, usually on a T4A slip.[5] The IP and paying blocks list both. If the role needs day-to-day direction, the switch block and the EOR page cover employment instead.
Contractor or employee: the test in Canada
The test
Outside Quebec, the Canada Revenue Agency first asks what the worker and the payer intended, then checks it against the facts: the payer's control over the work, who provides tools and equipment, whether the worker can subcontract or hire assistants, financial risk, responsibility for investment and management, and opportunity for profit. The payer's right to control counts, whether or not it is used. In Quebec the CRA applies the Civil Code of Québec: carrying out the work, remuneration and a relationship of subordination.
Who decides
The CRA's CPP/EI rulings program: the worker or the payer can ask for a ruling by June 29 of the year after the year in question. The ruling says whether the employment is pensionable (CPP) or insurable (EI).
If it is employment
An employer who failed to deduct CPP contributions or EI premiums pays both the employer's and the employee's share owing, plus penalties and interest.[1]
What mistakes cost
Canada: what hiring mistakes cost
Mistake
Who is liable
Cost
CPP, EI or income tax not deducted, for example from a worker treated as self-employed who is an employee
The payer
A penalty of 10% of the CPP, EI and income tax not deducted; for CPP and EI, both the employer's and the employee's share owing, plus interest[6][1]
Legal form and tax
Contractor working through their own corporation
If the person would reasonably be the client's employee but for the corporation, the CRA can treat it as a personal services business, with no small business deduction, an additional 5% tax and limited deductible expenses.[2]
Tax
A self-employed person pays the full 11.9% CPP contribution on their own earnings, the employee and employer portions together.
VAT
A contractor whose worldwide taxable supplies do not exceed CAD 30,000 is a small supplier and is not required to register for GST/HST.[7][4]
Contract and IP
Who owns the work
Under the Copyright Act the creator of a work is its first copyright owner; an employer is first owner only of what its staff create while employed, unless agreed otherwise. For a contractor's work, the client needs a written assignment signed by the owner.[3]
How to pay a contractor in Canada
T4A slip
Fees for services above CAD 500 in a calendar year paid to a business must be reported to the CRA in prescribed form, usually the T4A slip.[5]

How does the CRA decide if a contractor is an employee?
It asks what the worker and the payer intended when they set up the arrangement, then tests that against control, tools and equipment, subcontracting or hiring assistants, financial risk, investment and management, and opportunity for profit.
Is the test different in Quebec?
Yes. In Quebec the CRA applies the Civil Code of Québec and looks at carrying out the work, remuneration and a relationship of subordination.
Who can ask the CRA for a ruling on a contractor's status?
The worker or the payer, by June 29 of the year after the year in question. The ruling says whether the work is pensionable under CPP and insurable under EI.
Who owns the work a Canadian contractor creates?
Under the Copyright Act the author owns the copyright first. The employer-ownership rule covers employees only, so a client gets a contractor's copyright through an assignment in writing signed by the owner.
