19 EOR providers if the work becomes employment
A Spanish autónomo can work for you without an entity of yours, provided the work stays outside your organisation and your direction. Earning most of their income from you does not change that test.
Short answer
Someone who works for pay within your organisation and under your direction is presumed to be your employee, whatever the contract says.
An autónomo whose single biggest client pays 75% or more of their income is a TRADE, a status inside self-employment.
A company in Spain paying an autónomo's fee withholds 15% for income tax, or 7% in the contractor's first years of activity.
Without a written assignment, the contractor keeps the rights to the work they create for you.

Where the employee line runs in Spain
The line is drawn by organisation and direction. The Workers’ Statute applies to anyone who works voluntarily, for pay, on someone else’s account and within that person’s organisation and direction [1], and the law presumes an employment contract wherever a service is provided on those terms for pay, written or not [2]. The law on self-employment draws the same line from the other side: an autónomo works habitually, personally and directly, on their own account and outside another person’s organisation and direction [3]. A person you manage like your team sits on the employee side whatever the invoice says.
Dependence on one client is a separate matter. An autónomo who depends on one client for 75% or more of their income is a TRADE (trabajador autónomo económicamente dependiente) [3], which remains a form of self-employment.
When the line is crossed, Social Security comes first. The unpaid contributions are claimed with a surcharge [4], and each worker never registered is a separate fine [5]. The risk block gives the look-back and the mistakes table the amounts.
Setting up the contract and the IP
A written services contract helps only when it matches how the work runs. Since the test looks at organisation and direction [1], terms that leave the contractor to plan and carry out the work their own way carry more weight than the label on the document.
Intellectual property needs its own clause. A contractor keeps the rights to what they create until they assign them, and the assignment has to be in writing. It reaches only the uses it names; with no term stated it lasts five years, and with no territory it covers only the country where it was made [6]. The rule that hands an employer the software its staff write in their duties applies to salaried employees [7], so a contract with an autónomo has to name the rights, the uses, the term and the territory itself.
The Workers' Statute covers anyone who works voluntarily, for pay, on another's account and within that person's organisation and direction, and the law presumes an employment contract between whoever provides a service on that basis and whoever receives it in exchange for pay, whether the contract is written or verbal.
Who decides
Fines follow proceedings opened on a proposal of the Labour and Social Security Inspectorate. Social Security can register the worker of its own motion, and the worker can apply for registration directly when the employer has not.
If it is employment
Social Security claims the unpaid contributions, with a surcharge of 20%, or 35% after the deadline in the debt claim, where they were never reported. Not registering an employee is a serious infraction, fined EUR 751 to 7,500 for each employee.
Look-back for back contributions
4 years[1][2][5][8][4][9][10]4 years for contribution debts and Social Security infractions; 3 years for other labour infractions
What mistakes cost
Spain: what hiring mistakes cost
Mistake
Who is liable
Cost
Unlawful transfer of workers (cesión ilegal de trabajadores)
Both companies
A very serious infraction, fined EUR 7,501 to 225,018, plus joint liability for pay and Social Security debts, and the worker may choose permanent status with either company.[11][12]
Employee not registered with Social Security on time
Employer
A serious infraction, fined EUR 751 to 7,500 for each employee affected.[5]
Social Security contributions paid late
Employer
A surcharge of 10% or 20% of the debt when the contributions were reported on time, and 20% or 35% when they were not.[4]
Legal form and tax
Self-employed worker (trabajador autónomo)
An individual who works habitually, personally and directly, on their own account and outside the organisation and direction of another person. They must join the Social Security scheme for the self-employed (RETA).[3][13]
A self-employed worker who receives at least 75% of their income from one client.[3]
Tax
A company in Spain that pays a professional's fee withholds 15% of it as an income-tax prepayment, or 7% in the year the contractor starts the activity and the two years after, when the contractor tells it so; a foreign payer withholds when it operates in Spain through a permanent establishment. A professional whose income was not at least 70% withheld in the previous year pays 20% of net profit in quarterly instalments, by 20 April, 20 July, 20 October and 30 January.
VAT
Standard VAT rate 21%. A service to a business is taxed in Spain when the client business is based there or has a permanent establishment there that receives it.[14][15][16][17]
Contract and IP
Who owns the work
The contractor keeps the rights unless they assign them in writing. An assignment covers only the uses it names; with no term it lasts five years, with no territory it covers only the country where it was made, and with no uses named it covers only what the contract's purpose requires. Software an employee writes in their duties belongs to the employer unless agreed otherwise; no such rule applies to a contractor.[6][7]
How to pay a contractor in Spain
Invoice from the contractor
A self-employed professional must issue an invoice for each service, including services outside the scope of Spanish VAT; for a business client, before the 16th of the month after the one in which the VAT fell due.[18]
Withholding return (when the payer withholds)
A payer that withholds declares and pays the amounts each quarter, in the first 20 days of April, July, October and January, and files an annual summary in January.[19]

Who checks whether a contractor in Spain is really an employee?
The Labour and Social Security Inspectorate, on whose proposal fine proceedings open. Social Security can also register the person as an employee of its own motion, and the worker can apply for that registration directly.
Does a contractor with one main client become an employee in Spain?
Not by that fact alone. An autónomo who gets 75% or more of their income from one client is an economically dependent self-employed worker (TRADE), still self-employed. Employment turns on organisation and direction.
How far back can Spain claim contributions for a misclassified contractor?
Four years. Social Security can assess and claim unpaid contributions for that long, with a surcharge of 20% or 35% where they were never reported. Other labour infractions expire after three years.
Who owns the work a contractor creates in Spain?
The contractor, until they assign the rights in writing. An assignment covers only the uses it names; without a stated term it lasts five years, and without a territory it covers only the country where it was made.
What are the alternatives if a contractor's work in Spain looks like employment?
Employing the person, through your own Spanish company or an Employer of Record. Either way, employer contributions and the protections of the Workers' Statute apply, and an EOR raises a legal question of its own in Spain.
